These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Phrax Inc. ("Phrax Inc.," "we," "us," or "our"), the developer and operator of the Symptom Atlas mobile application ("the App").
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
Symptom Atlas is a personal health tracking application that allows users to log, monitor, and review symptoms across multiple body systems. The App is designed for personal informational use only.
Symptom Atlas is not a medical device. It has not been evaluated, cleared, or approved by Health Canada, the U.S. Food and Drug Administration (FDA), or any other regulatory authority as a medical device or medical software.
The information and data generated by the App are for personal informational purposes only and do not constitute medical advice. Always seek the advice of a qualified healthcare provider regarding any medical condition or symptom.
In a medical emergency, call 911 or your local emergency number immediately. Do not rely on this App in any emergency situation.
All data you enter into the App is stored exclusively on your device. Phrax Inc. does not collect, transmit, receive, or store any of your personal or health data on any server.
The App does not require you to create an account or provide any personal information. No registration, login, or email address is required.
Because all data is stored locally on your device, you are solely responsible for backing up your data, securing your device, and managing deletion. If you uninstall the App or lose your device, your data may be permanently lost. Phrax Inc. has no ability to recover it.
PDF reports are generated on your device and shared using your device's native share sheet. Phrax Inc. does not receive or store exported files.
You may use the App for personal, non-commercial symptom tracking. You agree not to:
The App, including its design, code, branding, and logo, is the exclusive intellectual property of Phrax Inc. and protected by applicable law. You are granted a limited, non-exclusive, revocable licence to use the App for personal use only.
The name "Symptom Atlas," the name "Phrax Inc.," and the Phrax Inc. logo are proprietary to Phrax Inc. You may not use them without prior written permission.
The App is provided "as is" without warranty of any kind. Phrax Inc. disclaims all warranties including warranties of merchantability, fitness for a particular purpose, that the App will be error-free, uninterrupted, or free of harmful components, or that information generated by the App will be accurate or complete.
To the maximum extent permitted by the laws of Ontario and Canada, Phrax Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, decisions made based on App information, or any delay in seeking medical care.
In no event shall Phrax Inc.'s total liability to you exceed the amount you paid for the App in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Phrax Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the App or your violation of these Terms.
Phrax Inc. reserves the right to modify these Terms at any time. We will update the effective date and provide notice where reasonably practicable. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
You may stop using the App at any time by uninstalling it. Phrax Inc. reserves the right to discontinue the App or any of its features at any time without notice. Phrax Inc. has no obligation to preserve any data after termination.
These Terms shall be governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any dispute shall be resolved by the courts of Ontario, Canada.
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force and effect.
